Terms of Service

These Terms of Service (“Terms”) govern your use of the website, social media pages, and services (the “Sites”) operated by Friends of Mera K. Corlett (the “Campaign”), including but not limited to contributions, event ticket purchases, e-commerce transactions, subscribing to email or text notifications, and creating user accounts. By using our Sites, you agree to comply with and be bound by these Terms. Please read these Terms carefully. If you do not agree to these Terms, please do not use our Sites.
Use and Conduct
We expect you to help keep the Campaign’s platform and community secure, safe, and respectful. Your activity on the Sites must comply with these Terms and any additional supplemental terms and policies that apply to certain services or features that you use. We reserve the right to suspend access to our Services, delete accounts, or take other reasonably necessary steps to address a violation of these Terms.
Respecting Laws: Your use of our Sites must comply with all applicable local, state, national, and international laws, rules, and regulations.
Respecting Others: You may not use our Sites to do anything that infringes or violates someone else’s rights, including their privacy and intellectual property rights. You cannot use our Sites to abuse or harm others, including threatening or encouraging such abuse or harm. For example, you cannot use the Campaign’s Sites to mislead, defraud, illegally impersonate, defame, bully, harass, or stalk others.
Respecting the Campaign: You cannot abuse, harm, interfere with, or disrupt the Campaign’s Sites or other operations, including the Campaign’s technology and infrastructure. For example, you cannot access or use our Sites in unpermitted ways, introduce malware or spam, or attempt to circumvent our security, integrity, and other protective measures.
GENERAL EXPECTATIONS
Account Security: If you have an account on the Campaign’s Sites, you are responsible for keeping it secure, and for anything that occurs if someone else is signed in to your account. The Campaign is not liable for any loss or damage resulting from your failure to maintain the security of your account or your password, and we expect you to contact us immediately if you believe your account is compromised.
Misuse of Services: You are not permitted to access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any part of our Sites, including Content hosted or made available by the Campaign, except as permitted by these Terms or with our prior written permission and, if applicable, the respective rights holder. You may not cause or encourage any inaccurate measurements of user engagement with our Sites, or access our Sites using automated means—such as bots or scrapers—except in the case of indexing for public search engines or with our written permission.
Prohibited Conduct: You may not access or use, or attempt to access or use, the Sites to take any action that could harm us or any other person or entity, interfere with the operation of the Sites, or use the Sites in a manner that violates any laws. For example, and without limitation, you may not
- Impersonate any person or entity or otherwise misrepresent your affiliation or the origin of materials you transmit;
- Harass or materially interfere in any manner with another user’s use or enjoyment of the Sites;
- Engage in unauthorized spidering, “scraping,” or harvesting of content or personal information, or use any other unauthorized automated means to compile information;
- Use the Sites to access, harvest, copy, collect, gather, or assemble information or data regarding other users of the Sites without the applicable user’s prior express consent;
- Take any action that imposes an unreasonable or disproportionately large load on our network or infrastructure;
- Use any device, software or routine to interfere or attempt to interfere with the proper working of the Sites or any activity conducted on the Sites or attempt to probe, scan, test the vulnerability of, or breach the security of any system or network, including without limitation via any viruses, corrupted data, or other harmful, disruptive or destructive files;
- Attempt to modify, copy, make derivative works of, decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of the Sites;
Violations of system or network security may result in civil or criminal liability. We may investigate and work with law enforcement authorities to prosecute users who violate these Terms.
Prohibited Commercial Activity: You may not use our Services to (i) distribute unsolicited commercial content, which is any media or material that is distributed with the intention of promoting, advertising, or generating revenue for a particular product, service, or for-profit business; [or (ii) use our Services to sell or market consumer products, advertising, sponsorships, or promotions to or on behalf of yourself or others.
Reporting: We appreciate your help in reporting suspicious activity on our platform and potential violations of these Terms.
Contributions
The Campaign allows users to make financial contributions through our Sites, which may be related to events, causes, or other activities. Contributions are processed through Stripe (a third-party payment processor), and are subject to Stripe’s Terms of Service and Privacy Policy.
YOUR COMMITMENTS
Age Requirements: You must be at least 18 years old, or the age of majority in your state of residence, to submit contributions. If we become aware that a contributor is under this minimum age, we will refund the contribution and may suspend the user’s access to our Services and/or delete any associated account.
Accuracy of Information: To promote the safety and accountability of our platform and community, you shall truthfully represent yourself when using our services. You must provide us with accurate, complete, and updated information for your account or when making a contribution.
Contract Authority: If you are making contributions on behalf of an organization or entity, you represent that you have authority to bind that organization or entity to these Terms. All references to “you” and “your” in these Terms will apply to both you and that organization or entity.
Restricted Users: You cannot make contributions if we have previously disabled your account or restricted your use due to violation of these Terms or other terms and policies, unless we specifically permit you to do so.
Other Limitations: To be eligible to make political contributions, you must
- be a a U.S. citizen or lawfully admitted permanent resident (i.e., green card holder);
- not be a person who is barred from doing so under the laws of the United States or any other applicable jurisdiction;
- be making the contribution with your own personal credit or debit card and not with a corporate or business credit card or a card issued to another person;
- understand that the maximum amount you are allowed to contribute is $2,100 designated for the primary election and $2,100 designated for the general election;
YOUR TRANSACTIONS
Payment Authorization: When you make a contribution, we may ask you to provide certain information to complete your contribution, including your contact and payment information, and you expressly authorize Stripe to charge the payment method you provide for the amount specified.
Recurring Contributions: Some of our features provide the ability for you to make recurring contributions, such as on a monthly basis. If you make a recurring contribution, you authorize Stripe to automatically initiate recurring payments as set forth in these Terms. Your recurring contribution will automatically continue at the selected interval, and we will charge at the designated cadence (e.g., monthly) unless prior to the next contribution you cancel, pause, or otherwise modify your recurring contribution; Instructions to cancel, pause, or otherwise modify your recurring contribution will be provided in email notifications. You may cancel recurring contributions at any time, but please note that such cancellation will be effective only for future charges associated with your recurring contributions. If you have questions about recurring contributions or believe you made a recurring contribution in error, please contact us.
Refunds: Please review your contribution amount and personal details carefully before submitting. The Campaign will make best efforts to accommodate requests for refunds and will honor each request on a case-by-case basis and at our sole discretion or where required by law. All refund requests are subject to the availability of funds. Any refund issued by the Campaign will be credited back to the original payment method used to make the contribution.
FUNDRAISING EVENTS
The Campaign facilitates the purchase of event tickets and contributions related to events, processed via Stripe.
Event Ticket Purchases: Tickets for events are subject to availability and may be subject to additional terms from event organizers.
Refunds and Cancellations: All ticket sales are final. Refunds or cancellations will be issued in accordance with our Refunds policy (above), or as explicitly stated in the event details.
Event Changes:The Campaign may not be the sole or primary organizer for all events listed on our website, and thus are not necessarily responsible for changes to event schedules or cancellations. The Campaign and/or event organizers will notify you regarding refunds or rescheduling.
Text Messaging
By providing your phone number, you agree to receive recurring automated marketing and informational text (e.g., SMS and MMS) messages from the Campaign including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. All the different types of messages you may receive informational messages, recurring marketing messages, fundraising, on-demand reply to messages, etc. shall be known collectively as the “Programs.” Consent to receive automated marketing text messages is not a condition of any purchase.

Data Privacy: Your phone number and personal information will be handled in accordance with our Privacy Policy.
Message Frequency: Message frequency will vary. We reserve the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. We also reserve the right to change the phone number from which messages are sent.
Cancellation: If you do not wish to continue participating in any Program or no longer agree to these Terms, you agree to text the applicable Short Code (or regular long code phone number where applicable) or directly reply to any mobile message received from a Program with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT in order to opt out of that Program at any time. You may receive an additional mobile message confirming your decision to opt out.
You understand and agree that the foregoing options are the only reasonable and exclusive methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words or phrases other than those set forth above or verbally requesting to be removed from our list, is not a reasonable means of opting out. You may be subscribed to multiple Programs across different Short Codes or regular long code phone numbers, and therefore you must separately text or reply STOP to each Short Code or long code phone number from which you wish to unsubscribe.
Support: For support regarding the Program, text “HELP” to the applicable Program’s Short Code or long code, or contact us here. Please note that sending a message or texting “HELP” to the Program’s Short or long Code is not an acceptable method of opting out of the program. Opt-outs must be submitted in accordance with the procedures set forth above.
Disclaimer of Warranty: The Programs are offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with any Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator, and is outside of our control. We are not liable for delayed or undelivered mobile messages.
Email Messages
By providing your Email Address, you agree to receive emails from the Campaign, and in some cases be subscribed to the Campaign’s email list. Emails from the Campaign may be transactional (automated responses to activity on the website, such as submitting a form, placing an order, or commenting on a page), informational, or promotional in nature.
Subscription Confirmation: In some instances, upon the submission of a website form, the Campaign may send a notification to the submitted email address requesting that the user confirm their intention to subscribe to the Campaign’s email list. This is in order to keep our lists clear of any email addresses submitted by bots or other ill-intentioned parties. The Campaign respects people’s inboxes and wants to ensure that we’re only sending email to people who want to hear from us.
Data Privacy: Your email address and personal information will be handled in accordance with our Privacy Policy.
Email Frequency: Email frequency will vary. We reserve the right to alter the frequency of messages sent at any time. The Campaign commits to avoid sending excessive or unsolicited emails.
Unsubscribing: You can adjust your email preferences at any time. If you do not wish to continue receiving emails from the Campaign or no longer agree to these Terms, you can unsubscribe at any time by clicking the “unsubscribe” link in any of our emails You may receive an additional email message confirming your decision to unsubscribe.
You understand and agree that the foregoing options are the only reasonable and exclusive methods of unsubscribing from the Campaign’s email list. You also understand and agree that any other method of unsubscribing, including, but not limited to, sending an email or verbally requesting to be removed from our list, is not a reasonable means of unsubscribing. You may be subscribed to multiple lists, and therefore you may need to specify from which list you wish to unsubscribe.
Electronic Communications and Privacy Policy
You consent to our communicating with you about the Sites and the Campaign via email, text message, or other electronic means. Please refer to our Privacy Policy for information on how we collect, manage, use and disclose information from our users. You agree that you will not provide any other person’s personal information to us unless you have the rights to do so under applicable law and have shared our Privacy Policy with the applicable person.
Google Maps and Geolocation/ Geocoding Services
The Sites integrates Google Maps and associated APIs, including but not limited to the Geolocation and Geocoding APIs, to enhance the user experience by providing location-based features and services. Our use of these APIs is subject to Google’s Privacy Policy and the Google Maps Platform Terms of Service.
Consent to Use Location Data: Geolocation refers to the process of identifying the physical location of a device or user, often using GPS, IP address, Wi-Fi, or cellular data. It allows websites and applications to determine and utilize a user’s real-world location, typically to provide location-based services or content. The Sites do not collect or store users’ location data by default. Requests to the Geolocation API are only made after your browser asks permission to use location services, which is triggered by an action you take, such as clicking a ‘Show My Location’ button on the map. Even after you grant permission to allow location services, your location data is only used to display your current location on the map for your own use and is not stored by the Site. This ensures that any retrieved location data remains private and is not retained beyond its immediate use.
Google’s Terms: By using the Sites, you acknowledge that you are also bound by Google’s Terms of Service.
Accuracy of Information: The Campaign and Google make efforts to ensure the accuracy of geolocation data; however, we cannot guarantee the absolute accuracy or availability of location-based services. Users are responsible for verifying any location information used for navigation or location-based services.
Address Geocoding: When you submit an address on the Site, we may utilize the Google Geocoding API to convert the address into geographic coordinates (latitude and longitude). These coordinates are used to generate maps and enhance location-based features on the Site, primarily for internal purposes. In some instances, geocoded address data may be used to display a map solely for the specific user who submitted the address. This geocoding functionality enables us to provide relevant location information and mapping tools that support the Campaign’s operations. Maps generated with aggregated geocoded user data are not publicly available; access is limited to authorized Campaign personnel only to ensure user privacy is protected.
Data Standardization and Corrections: The Geocoding API may also be used to modify address entries to follow a standardized format (e.g., changing “1000 FOREST AVENUE” to “1000 Forest Ave”). In some cases, the API may also fill in missing address details, such as city, state, or postal code, or correct inaccuracies based on Google’s best match for the submitted address data.
User Content and Interactive Areas
The Sites may include interactive areas or services, such as blogs, forums, event pages, or other areas or services in which you or other users may create, post, share or store content, messages, materials, data, information, text, graphics, audio, video, or other items or materials on the Sites (“User Content”). You are solely responsible for your use of the Sites and use them at your own risk. By posting, uploading to, transmitting, distributing, storing, creating, or otherwise publishing through the Sites any User Content, you agree to the following Terms—
Appropriate Content: You agree to post only Content that is respectful, lawful, and relevant to the subject matter. User Content that is unlawful, libelous, defamatory, false, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, hateful, inflammatory, fraudulent, deceptive or misleading, is not allowed and will be removed at our discretion.
User Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law, is forbidden. Such User Content that may, in our sole judgment, expose the Campaign or others to any harm or liability, will be reported to the appropriate authorities.
Ownership, License, and Trademarks: You acknowledge and agree that any feedback, questions, comments, suggestions, ideas, or other information or materials regarding the Sites or the Campaign that are provided by you in the form of email, submissions, or any such postings on the Sites, are non-confidential and shall become the sole property of the Campaign. The Campaign shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these materials for any purpose without acknowledgment or compensation to you. To the extent you have any rights, title, or interest in any of the foregoing, you shall assign, and hereby assign, any and all such rights, title, and interest to the Campaign. User Content that may infringe, misappropriate, or otherwise violate any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party.
Moderation: All Content is subject to moderation, and although the Campaign has no obligation to do so, it reserves the right, and has sole discretion, to remove, screen or edit any User Content that violate these Terms or that we deem inappropriate.
Repeat Infringer Policy: In accordance with applicable law, the Campaign has adopted a policy of terminating, in appropriate circumstances as determined by the Campaign in its sole discretion, subscribers or account holders who are deemed to be repeat infringers. The Campaign may also at its sole discretion limit access to the Sites and/or terminate the accounts of any users who infringe, misappropriate, or otherwise violate any intellectual property rights of others, whether or not there is any repeat infringement, misappropriation, or violation.
Liability: You are solely responsible for any Content you submit to the Sites, and any consequences that result from your submissions. The Campaign takes no responsibility and assumes no liability for the Content posted by users.
General Provisions
Changes to these Terms: The Campaign may update these Terms from time to time as we improve our platform and develop new services and features. Unless otherwise required by law, we will let you know of any important changes by revising the date at the top of these Terms. In some cases, we may add an additional early notice on our website or send you an email if you provided us with that information. Your continued use of the Services after changes indicates your acceptance of the new Terms.
Entire Agreement: These Terms, including any additional terms and policies referenced within, comprise the entire agreement between you and the Campaign and supersede any prior agreements. If we do not enforce a provision in these Terms, it will not be considered a waiver of our rights to enforce these Terms. We reserve the right to transfer our rights under these Terms and provide the Services using another entity. You may not transfer any of your rights or obligations under these Terms without our consent. We reserve all rights not expressly granted to you.
Termination: The Campaign reserves the right at any time to modify, suspend, discontinue, or terminate, temporarily or permanently, some or all of the Services (or any part thereof), with or without notice and without liability to you or any third party.
The Campaign may terminate or suspend your right to access some or all of the Services, without prior notice or liability, if you breach any of the terms or conditions of these Terms or the Privacy Policy, including using the Services in violation of any applicable law such as trade controls or anti-terrorism laws. Should the Campaign suspect that an individual or entity is using its platform in violation of said laws, we reserve the right to investigate the suspected unlawful conduct. The Campaign will immediately suspend or terminate an individual or entity determined to have violated applicable law.
Limitation of Liability: To the maximum extent permitted by law, the Campaign, its affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including contributions, event participation, or product purchases.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States of America, the Commonwealth of Kentucky, and Jefferson County, without regard to its conflict of law provisions.
